Note
This "Act" is actually a collection of some 7 acts, which were all passed as a single bill.
Preamble
Whereas the Criminal Code has a lot of minor issues,
Whereas everyone agrees it would be better if cleaned up a little.
The following amendments to the criminal code are hereby passed into law:
Act 1: Did you Forget what an Inchoate Offense is Amendment
Preamble
Whereas inchoate offenses are auxiliary and placed before normal charges,
Whereas Criminal Code Article 16a Unlawful Use of Alternate Accounts is not an Inchoate Offense but is in the Inchoate Offenses Part,
Believing it would better fit below Article 23 Resisting Arrest.
The following changes are hereby made to the criminal code:
Article 1 — Changes
§1. Article 16a of the Criminal Code is moved below Article 23 Resisting Arrest and renumbered to Article 23a.
§2. If Article 23 is not Resisting Arrest at the time of this law passing whichever article has the title Resisting Arrest shall be the reference point for the placement and numbering of the current Article 16a.
Act 2-Abuse? No! Misuse? Probably. Amendment
Preamble
Whereas the terms of abuse of permissions require malicious intent,
Whereas this was not the case in the past,
Recognizing some anti social action can be non-malicious,
Believing things should go back to the way they were.
The following changes are hereby made to the Criminal Code:
Article 1 — Misuse of Permissions
§1. The text of Criminal Code Article 31 Abuse of Permissions is to be replaced in its entirety by the following:
Article 31. Misuse of Permissions
§1. Whoever knowingly and intentionally uses their permissions and powers inappropriately, in a manner not related to the official work for which the permissions and powers are given, commits the crime of Misuse of Permissions.
§2. There must be demonstrable social harm to prosecute under this Article.
§3. The sentences available for Misuse of Permissions shall be a mute of up to one (1) week.
§2. If Article 31 is not Abuse of Permissions at the time of this law passing whichever article has the title “Abuse of Permissions” shall be the reference point for this amendment.
Act 3: Grammar Police Amendment
Preamble
Whereas Criminal Code Article 51 Poaching does not have capitalization or periods where appropriate,
Whereas while writing this I noticed other issues with this Article,
Believing the Criminal Code ought to at least look presentable,
Recognizing Brandmal helped me rephrase parts of the Article.
Article 1 — Cleanup
§1. All sentences in Article 51 Poaching shall have their first word capitalized and have a period placed at their end, if one is not already present.
§2. Article 51 §2 shall be reworded to read “Poaching shall only be illegal during the first seven (7) days of the individual joining the relevant part of SimDemocracy.”
§3. Article 51 §2.1 shall be removed.
§4. Article 51 §2.2 shall be renumbered to §2.1 and reworded to read “Individuals rejoining the server after a period greater than one (1) year shall be considered new for the purposes of this Article.”
§5. If Article 51 is not Poaching at the time of this amendment passing, whichever article has the title “Poaching” shall be the reference point for this amendment.
Act 4: Harassment Declutter Amendment
Preamble
Whereas the Harassment Article in the Criminal Code is cluttered and hard to read,
Believing misgendering and deadnaming should be crimes in their own right,
Hoping that separating those crimes into their own articles solves both problems.
Article 1 — Changes
§1. Article 53 Sections 1a, 1b, & 1c and all subsections therein are hereby repealed.
§2. The following Article shall be inserted below Article 53a Hate Speech: Article 53b — Misgendering §1. A person commits the crime of misgendering if they:
- §1.1. Refer to a person by a name they used prior to gender transition with the intention to deny, invalidate, or mock that person’s gender identity, or
- §1.2. Refer to or label another person with a gender that does not match their gender identity with the intention to deny, invalidate, or mock that person’s gender identity.
§2. A reference to gender identity under this Article shall not be construed to include purported gender identities created for the purpose to cause upset, demean, or humiliate a person’s protected characteristics.
§3. The sentences available for misgendering shall be a mute or ban above three (3) weeks.
§3. If the Article names and numbers are not aligned at the time of this amendment's passing, the names of the Articles shall be used to assign proper placement and numbering.
Act 5: Explicit Materials Inside this Document Amendment
Preamble
Whereas the term “suggestive” in the Sexual Harassment article of the criminal code is a tad broad,
Whereas the Court’s have issues interpreting said Article because of that,
Believing it would be okay if the wording was a little less broad.
Article 1 — Changes
§1. The first instance of the word “suggestive” in Article 54 of the Criminal Code Sexual Harassment shall be changed to “explicit”.
§2. If the Article names and numbers are not aligned at the time of this amendment's passing, the names of the Articles shall be used to assign proper placement and numbering.
Act 6: World's Shortest Amendment
Preamble
Whereas the Criminal Code has an outdated definition of a Discord mute,
Believing that the mechanism of a mute need not be defined,
Recognizing Chief Justice Alexa pointed this out to me.
Article 1 — Changes
§1. Criminal Code Article 4 §1.1 is hereby repealed.
Act 7: Failure to Report..? Normal Harassment!? That's All Wrong! Its Sexual! Amendment
Preamble
Whereas the failure to report sexual harassment Article references the wrong Article,
Believing that is incredibly stupid.
Article 1 — Changes
§1. The reference to Article 53 in Article 55 of the Criminal Code Failure to Report Sexual Harassment shall be amended to reference Article 54 Sexual Harassment.
