Military Instatment and Creation Act

Preamble

Whereas the SimDem Armed Forces (SDAF) structure and benefits are poorly laid out;

Whereas preserving the rights of veterans and active service members is of importance

Whereas homeland defense and readiness must have highest priority.

The following will be enacted into law by the Senate of SimDemocracy:

Article 1: Title

This Act shall be known as “Military Instatement and Creation Act ” or MICA

Article 2: Military Authorizations

Section 1: Military Pay

1: Any member of the SDAF will be entitled to a bi-weekly income.

2: There will be two different pay scales for if the military is ‘Mobilised’ or ‘Demobilised’.

Section 2: Military Positions

1: SDAF members swear loyalty to the State of SimDem, and to the protection of democracy, not individuals or positions.

2: Commissioned officers of the military must be sponsored either by a member of the Senate or a higher ranking commanding officer, and then confirmed by a simple majority vote.

2.1. This does not apply to the General, which shall be appointed by the President and then approved by a simple majority vote of the Senate.
2.2. There shall be one General, who shall be the highest ranking member of the SDAF and directly under the command of the President.

3: Officers above the rank of Field officer shall only have their commision stripped by a simple majority vote in the senate

4: No business owned by a member of the SDAF may conduct business with the SDAF. If a business has employees who are members of the SDAF they require a majority vote of support from the Senate before conducting any business with the SDAF.

5: SDAF Members may serve in a reserve status, they will only be activated at the discretion of the highest ranking officer

6: Reserve SDAF Members will be paid 50 Tau per month as maintenance

7: Members of the SDAF shall incur a 2 month commitment to a mandatory recall after their separation.

8: Once this legislation is signed into law, the current members of the SDAF shall retain their current ranks (or are automatically granted the equivalent rank of the newly established structure).

Section 3: SDAF Administration

1: SDAF members shall be tried in a court martial for criminal acts committed while in the service. They will be tried by a jury of their SDAF peers. This court martial is not a criminal trial, and is merely internal to the SDAF. No sentences that amount to a judicial action can be enacted by this court. As this is therefore not a criminal trial, the accused may also be tried by a civilian court in addition to the court martial.

2: SDAF members convicted of crimes in a court martial may have their pay and rank reduced.

3: SDAF members will be beholden to laws above the civilian populace as prescribed by Commanding Officers.

4: SDAF members shall retain their right to free speech, however they can be administratively punished for speech using their Military position against the SDAF or claiming the SDAF takes a stance on any political situation outside of approved public announcements.

5: SDAF members may be administratively punished by their Commanding Officer for infractions to SDAF policy not amounting to criminal acts.

6: The SDAF structure may only be changed by an act of the Senate

7: The President shall act as the Commander and Chief of the SDAF and assist in directing war efforts and providing authorization for military operations.

Article 3: Military Member Rights

Section 1: Titles awarded

1: Service members shall be any persons that serve in the SDAF, either in an active or reserve status.

2: War veteran shall be any persons that served in an active capacity during declared hostilities

Section 2: Service Member Grants

1: All active service members shall be granted free legal counsel to be paid out of the SDAF funds.

2: All active service members shall be granted a free channel in the discord under a new category of Military Housing should they request. The member will pay upkeep.

3: All active service benefits shall extend to those with War Veteran even after leaving service.

Section 3: Awards and Medals

1: The senate shall create and authorize medals and awards to be granted to military members upon eligibility or nomination.

2: Nominations for awards and medals shall be voted on by the Senate or other body as delegated in the creation of said award.

3: SDAF members may only display medals and awards they have been granted.

4: A SDAF Medal of Valor shall be created, granted to those who serve with Valor and Distinction in an active conflict

5: A SDAF VoD Liberation Medal shall be created, granted to those who served during Operation False Guillotine

6: A SDAF Meritorious Command Medal Shall be created, granted to those who show exceptional leadership in their duties.
