Preamble
Whereas, the recent Supreme Court ruling has highlighted inconsistencies in our laws, Whereas, the Terms of Service of the platforms utilized by SimDemocracy shall take precedence, Whereas, due process should be preserved to the greatest extent possible,
THE SENATE OF SIMDEMOCRACY PROCLAIMS:
Justice Using Secured Trials (JUST) Amendments
Article 1 - Constitutional Amendment
This article is not in force as it failed referendum. §1. The following section shall be added to “Article 17: Right to a fair hearing” of the Constitution:
- §3.1. An individual shall forfeit their right to defend themselves in person if their presence at trial poses a substantial risk to SimDemocracy.
Article 2 - Criminal Code Amendment
§1. The following section shall be added to “Article 2. Burden of Proof” of the Criminal Code:
- §1.1. If presenting a specific piece of evidence to establish an offense beyond a reasonable doubt would pose an existential risk to SimDemocracy, the courts may admit witness testimony in lieu of said evidence.
