Preamble

Wheras the current SDAF is established within two separate acts, they should be combined into one.

Wheras some minor changes are needed throughout the current MICA and what they can do, they are established throughout.

Wheras the Secretary of Defense should be allowed to create their own rank structure, they are now given this ability.

Article 1: Definitions:

§1. “SimDem” refers to SimDemocracy.

§1.1. “Times of peace” or “a time of peace” shall refer to times when SimDemocracy is not currently legally at war with another nation.
§1.2. “Times of war” or “a time of war” shall refer to times when SimDemocracy is currently legally at war with another nation.
§1.3. “Active-duty” shall refer to a member of the SimDemocry Armed Forces currently being given work and being paid.
§1.4. “Reserve status” refers to a member of the SimDemocracy Armed Forces currently in the Reserves.
§1.5. “SDAF” shall refer to SimDemocracy Armed Forces.
§1.6. “Salary pay” shall refer to a consistent value of Tau provided to someone over a period of time.
§1.7. “Service member” shall refer to an individual within the SDAF.

Article 2: Repeals

§1. The Military Instatement and Creation Act 2025 shall be repealed in its entirety.

§2. The Armed Forces Revision Act shall be repealed in its eternity.

Article 3: The Formation of the SDAF

§1. In order to preserve and protect the sovereignty of SimDemocracy and to ensure the rights of all SimDemocracy users, the Sim Democracy Government shall create and maintain an armed forces for the use of meme wars consisting of virtual military personnel, equipment, weapons, and tactics.

§1.1. These armed forces shall be known as the SimDemocracy Armed Forces, or SDAF.

Article 4: Secretary of Defense

§1. The position of Secretary of Defense (SecDef) shall be created to manage the SDAF.

§1.1. The Secretary of Defense shall be an executive officer who is nominated by the president and confirmed by a majority vote in the Senate.
§1.2. The Secretary of Defense may be removed from their position at the discretion of the president.

§2. The Secretary of Defense will be the highest ranking role within the SimDem Armed Forces and shall be known as the “General of the Armed Forces” during times of war.

§3. The Secretary of Defense will be the chief military advisor to the president and legislative branch and be prepared to answer any relevant questions from either authority.

§4. The Secretary of Defense will be tasked with submitting a report every two weeks to the senate and the president including:

The status of military readiness.

Budgetary expenditures and allocations

Ongoing or planned military operations, excluding classified matters that could compromise national security.

§5. The Secretary of Defense will be tasked with auditing the SimDem Armed Forces at the beginning of each presidential term by contacting the members of the SDAF either via dms or internal chats to confirm they are still ready and willing to serve in the SDAF.

§5.1. Service members who don’t respond to any contact methods by the Secretary of Defense after a period of 5 days post-contact with at least two contact attempts, and didn’t previously mention a period of inactivity, may be removed from their position in the SDAF with an “honourable discharge” by the Secretary of Defense.

§6. The Secretary of Defense shall have the ability to hire and discharge service members from the SDAF.

§6.1. The Secretary of Defense may create their own internal divisions and structure within the SDAF, including the creation of ranks with different pay grades.
§6.1.1. Any decisions involving the pay of service members must be approved by the President.

§7. With permission from the President, the Secretary of Defense may utilize the SDAF and its resources to conduct military or civil service operations.

§7.1. With permission from the President and Secretary of State, the Secretary of Defense may utilize the SDAF and its resources to conduct foreign civil service missions.
§7.1.1. The Secretary of State shall have final say on every action taken by the SDAF in foreign civil service missions.
§7.2. With permission from the President and Attorney General, the Secretary of Defense may utilize the SDAF and its resources to assist the Department of Justice in conducting intelligence operations involving terrorist organizations.
§7.2.1. The Attorney General shall have final say on every action taken by the SDAF in intelligence operations involving terrorist organizations.

Article 5: Meme Wars

§1. The SimDem Armed Forces’ primary function is to participate in meme wars.

§2. When SimDemocracy is legally at war, SDAF service members may create memes that are playfully or satirically against the nation SimDemocracy is at war with.

§3. Memes created by the SDAF may be posted throughout SimDemocracy in designated areas.

§3.1. SDAF memes may not be posted in any servers under the sovereignty of the nation SimDemocracy is at war at unless it is consented to by the other nation and only posted in designated areas approved by both nations.

§4. No use of spam, raiding, or brigading shall be utilized by the SDAF for the purpose of meme wars.

Article 6: The Reserves

§1. All members of the SimDem Armed Forces will by default be considered “within the SDAF Reserves”, or the “Reserves” for short, during times of peace.

§1.1. Service members within the SDAF Reserves shall not be given any mandatory duties or directives involving the Armed Forces while within the Reserves other than responding to contact from the Secretary of Defense. Individuals within the Reserves will not receive any salary pay.
§1.2. Service members in the Reserves may be placed into active duty by the Secretary of Defense with approval from the president and will be assigned duties or missions to work on. They will begin to be paid salary pay on the next payday.

§2. All members of the SimDem Armed Forces will by default be considered Active-duty during times of war.

§2.1. The president or Secretary of Defense may take any member of the SimDem Armed Forces off of Active-duty status to return them to reserve status at any time.

Article 7: Propaganda

§1. The SimDem Armed Forces will now be optionally tasked with creating pro-SimDemocracy pieces of media during times of peace.

§1.1. Pro-SimDemocracy pieces of media can include music, posters, physical or digital art pieces, videos, poems, stories, websites, or games that paint SimDemocracy in a positive light or represent national pride as deemed by the President or Secretary of Defense.
§1.2. Individuals within the SDAF Reserves may choose to create any type of Pro-SimDemocracy media to submit to the Secretary of Defense for the potential of receiving compensation, if the Secretary of Defense believes it is high enough quality.
§1.3. The Secretary of Defense may duly compensate service members for the Pro-SimDemocracy media they create with a value of Tau based on the level of quality and effort put within it. The Secretary of Defense will consult with the Secretary of Expansion or President to decide upon the quality of Pro-SimDemocracy media and the amount of compensation deserved.
§1.4. The Secretary of Defense may also contract businesses to create Pro-SimDemocracy media using the same pay standards.

§2. The Secretary of Defense will be provided a budget of 400 tau biweekly to be used to pay those who created Pro-SimDemocracy media. If the budget provided isn’t spent within a week period, it will be kept within the SDAF account until needed.

§2.1. A channel will be created to publicly share all the pieces of Pro-SimDemocracy media created called #Propaganda.
§2.2. The Secretary of Defense shall be tasked with publicly sharing the Pro-SimDemocracy media created by posting it within #Propaganda and news threads if they choose.
§2.3. Any private citizen, not contracted by the SDAF, may request to the Secretary of Defense put a piece of media they made in the #propaganda channel. The Secretary of Defense can agree to post the media in the #propaganda channel. The citizen will not be paid for this. The Secretary of Defense must use discretion to make sure only pro-SimDemocracy media is allowed in #propaganda unless told otherwise by the president.

Article 8: Conflict of Interest

§1. An active-duty member of the SimDem Armed Forces may not concurrently be a diplomat or delegate to a nation SimDemocracy is at war with.

§2. The Secretary of Defense may not use SDAF funds to pay themselves for Pro-SimDemocracy media that they made but may share that media in #propaganda.

§3. Any member of the SDAF convicted of criminal charges during their time in the SDAF shall be removed from their position with a dishonourable discharge.

Article 9: Funding

§1. The SDAF shall have a monthly budget which is set by the senate.

§2. The Active-Duty SimDemocracy Armed Forces members will be paid salaries by the Department of Treasury utilizing funds from the Government Reserve that fit within the SDAF budget.

§2.1. The Secretary of Defense shall be tasked with submitting an up-to-date weekly report listing the Discord username of every active-duty member of the SimDem Armed Forces and their salary amount to send to the Department of Treasury so they can receive pay.

§3. After the end of a war, the Secretary of Defense may ask the senate for an increased budget to pay out bonuses to specific members of the SDAF based on their service during the war. The senate may approve or not approve this.
