OHS Clarifiers Act
Preamble
Whereas the current Homeland Security Act has language in some clauses that could be specified better as not to not give OHS unintended jurisdiction, we now can specify more specifically what “hostile foreign action” is.
Whereas the OHS couldn’t arrest for their own warrants, the Director of the OHS shall have now the ability to make the arrest for OHS warrants.
Whereas in situations where an emergency border goes up, it’s unclear who can manage it and let people pass it, the OHS shall now have jurisdiction to handle that.
Whereas there is no period at the end of Article 4 Clause 4.3 (smh), there now shall be one.
The clearance level of OHS Agents shall now be clarified as under the discretion of the president.
Article 1
§1. Article 3 Clause 3.3. of the Homeland Security Act II shall be stricken and replaced with:
- §3.3. The term “hostile foreign action” as used in Article Three Section 3 shall be defined as foreign organizations or groups involved in actions, behaviors, or communications that indicate a desire, willingness, or intention to disrupt, hurt, or delay the regular activities of the SimDem community.
§2. Article 3 Clause §3.5.1, §3.5.2., and §3.6. of the Homeland Security Act II shall be stricken and replaced with:
- §3.5. The Office of Homeland Security shall be privileged to submit warrants for the arrest of persons inside their jurisdiction to the relevant judiciary.
- §3.5.1. The SDBI or Director of the OHS shall carry out all OHS arrest warrants that have been signed by a Judge.
- §3.6. In case of any border being put up to enter the SimDemocracy Discord Server, the Office of Homeland Security shall have permission to allow individuals to pass the border if they meet the proper guidelines set for the border.
- §3.6.1. OHS Agents shall be granted the necessary permissions to do so.
- §3.7. The motto of the OHS shall be, “Semper Vigilans.”
§3. A “.” shall be added at the end of Article 4 Clause 4.3.
§4. A new subclause shall be added to Article 5 Clause 5 which states:
- §5.4. OHS Agents shall have a security clearance level set at the discretion of the President.
