Homeland Security Act II

Whereas the Homeland Security Act is vague and needs clarification, the Senate shall act to clarify the roles, duties, jurisdiction, and limitations of the Office of Homeland Security

Article 1: Title and Implementation

§1. This act shall be known as the “Homeland Security Act II.”

§1.1. Upon passage, all articles and sections of this bill shall become law and shall be implemented by the relevant parties.

§1.2. Upon passage, the Homeland Security Act shall be considered null and void.

Article 2: Definitions

§2. The SimDemocracy Department of Justice may be referred to as “DOJ” throughout this bill.

§2.1. The SimDemocracy Department of Justice Office of Homeland Security may be referred to as “OHS” throughout this bill.

§2.2. The SimDemocracy Department of Justice SimDemocracy Bureau of Investigation may be referred to as “SDBI” throughout this bill.

§2.3. The state, government, citizenry, subreddit, and Discord of SimDemocracy may be referred to as “SimDem” throughout this bill.

Article 3: The OHS

§3. The Office of Homeland Security shall be an executive agency within the Department of Justice.

§3.1. The Office of Homeland Security’s mandate shall be to protect SimDem from outside and foreign forces that wish to harm or disrupt our democratic processes.

§3.2. The Office of Homeland Security shall have jurisdiction to investigate and enforce the laws of SimDemocracy on those who have been a member of the Subreddit or Discord server for seven days or fewer, or those determined to be involved in, committing, conspiring to commit, or planning to commit hostile foreign action against SimDem based on reasonable articulable suspicion.

§3.3. The term “hostile foreign action” as used in Article Three Section 3 shall be defined as actions, behaviors, or communications that indicate a desire, willingness, or intention to disrupt, hurt, or delay the regular activities of the SimDem community.

§3.4. The Office of Homeland Security shall play no role in internal policing or moderation, and shall not infringe on the duties of the SDBI to enforce the SimDem Criminal Code on persons outside the jurisdiction of the OHS.

§3.5.1. The Office of Homeland Security shall be privileged to submit warrants for the arrest of persons inside their jurisdiction to the relevant judiciary.

§3.5.2. The SDBI shall carry out all OHS arrest warrants that have been signed by a Judge.

§3.6. The motto of the OHS shall be, “Semper Vigilans.”

Article 4: The Director of the Office of Homeland Security

§4. The Director of the Office of Homeland Security shall be the highest-ranking position in the OHS.

§4.1. The Director of the OHS shall be responsible for leading the OHS, overseeing daily operations, setting OHS internal policies, and determining long-term security strategies.

§4.2. The Director of the OHS shall be appointed by the Attorney General of SimDemocracy and shall serve at their pleasure.

§4.3. The Director of the OHS shall have a security clearance level set at the discretion of the President

§4.4. The Director of the OHS shall have the authority to manage their agency’s members and set requirements for membership.

§4.5. The Director of the OHS shall control the Wick-bot account age threshold for new accounts joining the SimDem Discord and shall inform the Discord Supervisor of the proper setting to implement.

§4.6. The President, Attorney General, and Senate of SimDemocracy shall be notified of all changes to the Wick age-threshold settings.

Article 5: OHS Agents

§5. Members of the OHS may conduct investigations under the supervision of the Director of the OHS.

§5.1. Members of the OHS shall not advocate for, or conduct investigations for their own private advantage.

§5.2. Members of the OHS shall not share any information regarding ongoing or former OHS investigations with anyone without the necessary security clearance.

§5.3. Members of the OHS shall not use confidential information to their own private advantage.
