Preamble:

Whereas the former SimDemocracy Minecraft Server has been abandoned...Whereas user u/squiderman200, also known as Strix, has opened a new server "Strix_SMP" to act as a replacement... The following will be enacted into law by the Senate of SimDemocracy:

Article 1: Title

§1. This Act will be known as the “Minecraft Server Transfer Act” or MSTA.

Article 2: Denouncement of Past Servers

§1. The Establishment of a Minecraft Server Act is now void.

§2. Only the single official SimDemocracy Minecraft Server will be open to colonization and Discord discussion.

§3. All past Minecraft Servers will no longer be the Official SimDemocracy Minecraft Server.

Article 3: Officialization of Strix_SMP

§1. Strix_SMP is defined as the Minecraft World hosted at Strix_SMP.mc.gg and all of its ports.

§2. Strix_SMP will become the new sole Official SimDemocracy Minecraft Server.

Article 4: Ownership

§1. Strix will be defined as the Owner of the Minecraft Server for as long as Strix_SMP is the Official SimDemocracy Minecraft Server.

§2. The Owner of the Minecraft Server is not to utilise any power associated with being the individual that owns the Minecraft Server except to enact decisions of the users of the Minecraft Server or to support the Governor with any work the Governor asks for support for.

§2.1. The server owner shall hold emergency moderation powers to address immediate threats to the integrity or security of the Minecraft server.

§2.1.1. Upon invoking emergency powers, the server owner must notify the Governor immediately and provide a written explanation of the actions taken within 1 hour.

§2.1.2. An oversight committee shall be established, comprising the Governor and two Senators appointed by the Speaker.

§2.1.2.1. This oversight committee shall review the emergency actions within 24 hours.

§2.1.2.2. If the oversight committee does not approve the actions by a simple majority vote, the emergency actions shall be reversed immediately, and the owner may face an internal review process.

§2.1.3. Emergency powers shall not extend to actions that permanently affect the server, such as deleting infrastructure or banning users indefinitely, unless due process is afforded and such actions are specifically approved by the oversight committee, except for those emergencies which present a clear and present danger to the server's operation and playability.

§2.1.4. A public report summarizing the actions taken, their justification, and the oversight committee’s decision shall be issued within 48 hours of the emergency action. Classified details may be omitted for security reasons.

§2.2. The Owner of the Minecraft Server is to assist the SDBI and state prosecutors of SimDemocracy if there is any infringement of SimDemocracy law within the Minecraft server if specifically requested by the relevant authorities.

§2.3. The Minecraft Server Owner is to be granted a special flair within the discord server for users to determine who the owner of the Minecraft server is.

§2.4. The Minecraft Server Owner is to provide server backup files to SimDemocracy at regular intervals for the purposes of safeguarding the SimDemocracy Minecraft Server, thus in the event of an unreliable Minecraft Server Owner or potential shutdown, then the world can be recovered and restarted in a new Minecraft server.

§2.5. As a provision for the Minecraft Server Owner, they are to be released from any penalty should the server shutdown, given that the Server Owner is spending their own money to run it.

§3. If Strix_SMP cannot consistently abide by this law and the other laws and executive orders enacted by SimDemocracy, Strix_SMP, by a simple majority vote in the Senate and a ⅔ vote in the general populace, will lose its status as Official Minecraft Server.

§4. Non-SimDemocracy affiliated persons (NSDAPs) within the server have the freewill to inhabit it, so long as they abide by the laws set by SimDemocracy.

§4.1. However, if these NSDAPs violate SimDemocracy law and/or engage in hostilities against the SimDemocracy playerbase, the violator(s) will be banished from the established SimDemocracy territory to live in exile.

§4.2. Should a NSDAP violator do any of the following below, they are to be banned by the Governor or Owner of the Minecraft Server.

1.) Trespass on established SimDemocracy territory after being banned from it

2.) Violate SimDemocracy law

3.) Engage in hostilities against the SimDemocracy playerbase

Article 5: Legislative & Executive Power

§1. Legislation approved by the SimDemocracy Senate will be enforced within the Official Minecraft Server.

§2. The Governor shall have the authority to create and enforce executive orders that specifically pertain to the Minecraft Server.

§3. Executive orders made by the President will be enforced within the Official Minecraft Server.

§3.1. The Governor of the Minecraft Server may issue server specific Executive Orders, however cannot dismiss or overrule any Executive Orders or directives declared by the President of SimDemocracy.

Article 6: The Governor of the Minecraft Server

§1. The Governor of the Minecraft Server shall be elected by registered voters of SimDemocracy using the STAR voting method as described in §3 of the Appendix of the Constitution. There shall be an election conducted on the 3rd day of each month. The call for candidates and election process shall be conducted using the same timeframe as Presidential elections.

§1.1. The Governor of the Minecraft Server may be any individual user of SimDemocracy who plays on the Minecraft server except for the Discord, Reddit, or Election supervisor.

§1.2. The election of the Governor of the Minecraft Server is to be handled by the Elections Supervisor or a member of the Electoral Commision.

§1.3. The Governor of the Minecraft Server will be responsible for the following:

§1.3.1. Enforcement of law that pertains to the Minecraft Server.

§1.3.2. Any other responsibilities placed upon them by the legislature of SimDemocracy.

§1.3.3. Assisting the SDBI and state prosecutors of SimDemocracy if there is any infringement of SimDemocracy law within the Minecraft server.

§1.3.4. Encouraging the growth and well-being of the Minecraft Server.

§2. The Governor of the Minecraft Server will be given access to Minecraft Server admin privileges

§2.1. The Governor of the Minecraft Server may use these commands exclusively for factors outlined in 2 and all use of commands or admin powers, or any other use of the powers of the Governor of the Minecraft Server, must be compliant with the Constitution and laws of SimDemocracy as well as the laws of the Minecraft server.

§2.2. The President may issue executive orders for the Governor of the Minecraft Server.

§2.3. The Governor of the Minecraft Server may expand the established territory of the Official SimDemocracy Minecraft Server if said expansion benefits the SimDemocracy player base.

§2.4. The Governor of the Minecraft Server is to be granted a special flair within the discord server of SimDemocracy and a discord channel specifically for users of the Minecraft Server to be able to ask questions or report issues to The Governor about the Minecraft Server.

§3. If the office of the Governor of the Minecraft Server is vacant a special election shall be held by the Elections Supervisor or a member of the Electoral Commision following the normal election process.

§3.1. The special election shall not occur if the vacancy begins after the 23nd day of the month.

§3.2. The Owner of the Minecraft Server shall serve as the Acting Governor during a vacancy.
