Multitude Of Offices Act
Preamble
Whereas members of the cabinet have the ability to serve in both the executive branch and senate.
Whereas it is a responsibility of the branches to ensure that the separation of powers is followed and ensured to prevent a creation of a concentration of power over the branches of government
Article 1: Definitions
§1. A position in conflict is to be defined as a sitting member of The Cabinet, the head of the Office of Homeland Security (OHS) and the Director of the SimDem Bureau of Investigation (SDBI).
§1.1. The Cabinet will be referred to as both, ‘The Cabinet’ and ‘The Executive’ throughout this bill.
§1.2. A conflict of interest is to be defined as holding both a position in the previously stated cabinet and in the legislature at the same time in this bill.
§1.3. The senate will be referred to as both ‘The Senate’ and ‘The Legislature’ in this act.
§1.4. ‘Minor Positions’ are to be defined as members of the Department of Education and the Bureau of .
§1.5. ‘Elected offices’ are to be defined as positions appointed by the people in an election.
§1.6. ‘Appointed offices’ are to be defined as cabinet positions appointed by The Executive in this act.
Article 2: Conflicts of Interest
§2. The ability for a member of cabinet to serve in the legislature concurrently is barred.
§2.1. The ability for the OHS director to serve in the legislature concurrently is barred.
§2.2. The ability for the SDBI director to serve in the legislature concurrently is barred.
§2.3. The ability for the head of any futurely established agencies or departments in the executive to serve in the legislature concurrently is barred.
§2.4. Anybody who holds a minor position within the executive, will not be barred from serving in the legislature.
§2.5. The ability to serve in multiple offices elected by a public vote or appointed offices at the same time is barred.
§2.6. Any position which does not grant significant authority outside of the SimDemocracy Minecraft server is to be exempt from Article 2 of this act unless otherwise specified by legislation.
Article 3: Ensurance of the Act
§3. Any member of the cabinet who seeks election to the legislature, must resign or be removed from their position in the cabinet within 24 hours of being announced as a senator.
§3.1. The director of the OHS, if elected to the legislature, must resign or be removed from this post within 24 hours of being announced as a senator.
§3.2. The Director of the SDBI, if elected to the legislature, must resign or be removed from the post within 24 hours of being announced as a senator.
§3.3. Any member of the legislature, who is appointed to the cabinet, must resign their post in the legislature, or the cabinet, within 24 hours of their nomination.
§3.4. The heads of any futurely established agencies or departments who fit this criteria, are to resign or be removed from cabinet within 24 hours of being announced as a senator.
§3.5. Elected officials must resign or be removed from any additional elected position within 24 hours of their appointment.
§3.6. Appointed officials must resign or be removed from any additional appointed positions they hold within 24 hours of their appointment.
§3.7. Any position which does not grant significant authority outside of the SimDemocracy Minecraft server is to be exempt from Article 3 of this act unless otherwise specified by legislation.
Article 4: Implementation
§4. Upon the passage of this bill, all articles shall go into effect.
