Oath for Office Act
Article 1: Clarification
§1.1 Any person holding any of the offices specified in §2.1 at the time of the passage of this act shall be required to swear an oath.
§1.2 All instances mentioning “affirm/swear” require either of those words to be used and if both are used then they must be separated using “and”.
Article 2: Jurisdiction
§2.1 Any person who is either elected or appointed to be any of the following:
- Discord Supervisor,
- Reddit Supervisor,
- Election Supervisor,
- President,
- Vice President,
- Member of Cabinet,
- Judge,
- Justice,
- Senator,
- Governor of the Minecraft Server,
Shall take an oath according to their respective office as specified in Articles 3 and 4.
Article 3: Administration of the Oath
§3.1 The oath for the Discord, Election and Reddit Supervisors shall be administered in Official Announcements channel by the Chief Justice.
§3.2 The oath for the President and Vice President shall be administered in Official Announcements channel by the Election Commissioner.
§3.3 The oath for Cabinet Members shall be administered in Government Announcements by the President.
§3.4 The oaths for Judges and Justices shall be administered by the Chief Justice in the Supreme Court.
§3.5 The oath for Senators and the Speaker shall be administered in Senate formal by the Vice President.
§3.6 The oath for the Governor of the Minecraft Server shall be administered by the Owner of the Minecraft server on the official Minecraft Server.
§3.7 The administrator shall administer the oath by asking the oath taker to recite the oath and after the recitation of the oath the administrator shall proclaim them to the office they were appointed or elected to.
§3.8 The Oath may be administered and recorded in any Voice Channel if both the administrator and oath taker agree.
Article 4: Oath of Office
§4.1 The Supervisors shall take the following oath :
“I solemnly swear/affirm that I will faithfully execute the duties of this office. I will uphold the constitution and the laws of SimDemocracy in all circumstances. I will always act in the best interest of SimDemocracy and its citizens. I will never use this office for personal gain nor will I let my biases and personal opinion cloud my judgement. I shall never use the powers granted to me unless authorized and requested by the Law or Relevant Legal Authorities. In light of the words “When Tyranny becomes Law, Rebellion becomes Duty”, I will never be a Tyrant, will never endorse Tyranny and will use all means at my disposal to combat Tyranny. Ave SimDemocracy!”
§4.2 The President shall take the following oath :
“I solemnly swear/affirm that I will faithfully execute the duties of this office. I will uphold the constitution and the laws of SimDemocracy in all circumstances. I will always act in the best interest of SimDemocracy and its citizens. I will never use this office for personal gain nor will I let my biases and personal opinion cloud my judgement. I will respect the Separation of Powers and will oversee the executive branch in a manner that is responsible and allows for the efficient implementation of the Law. In light of the words “When Tyranny becomes Law, Rebellion becomes Duty”, I will never be a Tyrant, will never endorse Tyranny and will use all means at my disposal to combat Tyranny. Ave SimDemocracy!”
§4.3 The Vice President shall take the following oath :
“I solemnly swear/affirm that I will faithfully execute the duties of this office. I will uphold the constitution and the laws of SimDemocracy in all circumstances. I will always act in the best interest of SimDemocracy and its citizens. I will never use this office for personal gain nor will I let my biases and personal opinion cloud my judgement. I will aid the President or any other Agency of the Government in any duties legally required of me. In light of the words “When Tyranny becomes Law, Rebellion becomes Duty”, I will never be a Tyrant, will never endorse Tyranny and will use all means at my disposal to combat Tyranny. Ave SimDemocracy!”
§4.4 The members of the Cabinet shall take the following oath :
“I solemnly swear/affirm that I will faithfully execute the duties of this office. I will uphold the constitution and the laws of SimDemocracy in all circumstances. I will always act in the best interest of SimDemocracy and its citizens. I will never use this office for personal gain nor will I let my biases and personal opinion cloud my judgement. I will oversee my department in a manner that is responsible and allows for the efficient implementation of the Law. In light of the words “When Tyranny becomes Law, Rebellion becomes Duty”, I will never be a Tyrant, will never endorse Tyranny and will use all means at my disposal to combat Tyranny. Ave SimDemocracy!”
§4.4 Judges shall take the following oath :
“I solemnly swear/affirm that I will faithfully execute the duties of this office. I will uphold the constitution and the laws of SimDemocracy in all circumstances. I will always act in the best interest of SimDemocracy and its citizens. I will never use this office for personal gain nor will I let my biases and personal opinion cloud my judgement. Political agendas will have no influence on my decisions. All my decisions will be made in accordance with the law and the precedent of higher courts. Fiat iustitia! Ave SimDemocracy!”
§4.5 Justices shall take the following oath :
“I solemnly swear/affirm that I will faithfully execute the duties of this office. I will uphold the constitution and the laws of SimDemocracy in all circumstances. I will always act in the best interest of SimDemocracy and its citizens. I will never use this office for personal gain nor will I let my biases and personal opinion cloud my judgement. Political agendas will have no influence on my decisions. As a part of my service the independence and authority of the other branches of government will be respected and the rights of the citizens of SimDemocracy as laid out in the constitution will be safeguarded. Let no person, not even me consider themself above the law for Lex rex! and Nemo est supra leges! Ave SimDemocracy!”
§4.6 The Senators shall take following oath :
“I solemnly swear/affirm that I will faithfully execute the duties of this office. I will uphold the constitution and the laws of SimDemocracy in all circumstances. I will always act in the best interest of SimDemocracy and its citizens. I will never use this office for personal gain nor will I let my biases and personal opinion cloud my judgement. All Laws I propose will be primarily for the prosperity of SimDemocracy and never to its detriment. I will respect the separation of powers while also carrying out the Senate’s duty of oversight on the other branches of government. Ave SimDemocracy!”
§4.7 The Minecraft Governor shall take the following oath :
“I solemnly swear/affirm that I will faithfully execute the duties of this office. I will uphold the constitution and the laws of SimDemocracy in all circumstances. I will always act in the best interest of SimDemocracy and its citizens. I will never use this office for personal gain nor will I let my biases and personal opinion cloud my judgement. I will oversee the Minecraft Server in a manner that is responsible and allows for the efficient implementation of the Law. In light of the words “When Tyranny becomes Law, Rebellion becomes Duty”, I will never be a Tyrant, will never endorse Tyranny and will use all means at my disposal to combat Tyranny. Ave SimDemocracy!”
