Homeland Security Act

Preamble
Whereas the Office of Homeland Security is an integral part of the SimDem law enforcement community and plays a key role in national security, the OHS should be codified into law following Operation Kashmir.
Article 1: Title
§1. This act shall be known as the Homeland Security Act (HSA).
Article 2: Definitions
§2 The state, community, Discord, and Subreddit of SimDemocracy shall be referred to as SimDem throughout this act.
- §2.1 The SimDemocracy Bureau of Investigation shall be referred to as the SDBI throughout this act.
- §2.2 The SimDemocracy Department of Justice shall be referred to as the DOJ throughout this act.
- §2.3 The DOJ Office of Homeland Security shall be referred to as the OHS throughout this act.
Article 3: Codifying the OHS
§3 The DOJ Office of Homeland Security as established by Executive Order 134-2 shall be codified into SimDem law as a part of the Department of Justice.
- §3.1 The Office of Homeland Security shall remain a part of the Department of Justice under the authority and oversight of the Attorney General.
- §3.2 The Director of the Office of Homeland Security shall remain appointed by the Attorney General.
- §3.3 The Office of Homeland Security shall not be dissolved except by the passage of an act of the Senate and the signature of the President.
Article 4: Powers of the OHS
§4 The Director of the Office of Homeland Security shall direct the Discord Supervisor on the usage of the Wick Bot’s border security feature, preventing new accounts from accessing SimDem.
- §4.1 The Director of the Office of Homeland Security shall appoint agents to the OHS with the consent of the Attorney General.
- §4.2 Agents of the OHS shall have the authority to open OHS investigations and conduct lawful investigations including but not limited to “New account” interviews.
- §4.3 The OHS shall have jurisdiction over persons who have been a part of the SimDem community for seven days or fewer, and those who are reasonably suspected of being involved in, or having committed, “Hostile Foreign Action.”
- §4.4 “Hostile Foreign Action” shall be defined as behavior, conduct, or communications committed on behalf of an outside organization or government with hostile intent towards the SimDem community or the State of SimDemocracy.
- §4.5 OHS agents shall have the authority to place users under arrest if a warrant for their arrest based on probable cause has been signed by a judge.
Article 5: Implementation
§5 Upon passage of this act, all provisions of the act shall go into effect.
- §5.1 Upon passage of this act, this act shall become the law of the land.
